Guarantee for export forklift

1.1 We will provide replacements if fault happens during ultimate users’ normal using on account of unqualified material or manufacture. 12 months or 2000 working hours after receipt of bill of lading, which comes first is preferred, will be given as guarantee period to the following items:
Engine, controller assembly, gear box; driving axle; steering axle; wheel hub; wheel rim; cylinder; arrester; high-pressure hose; Pump; control valve; Fork; chain; mast bearing;
1.2 The guarantee period for starting battery on the diesel or LGP/gas forklift is 10 months. If a new forklift is in storage for 50 days without use, or a used forklift desists from working for 50 days without charging, guarantee to this starting battery will be abolished.
1.3 Guarantee period for wearing parts such as is 3 months. Wearing parts include:
1.4 All kinds of oils and filter, such as hydraulic oil, fuel, lube, brake oil, core in the hydraulic oil filter, which need to be replaced regularly, are excluded from guarantee.
1.5 The guarantee of the engine is performed as guarantee of repair, replacement and refund of substandard products offered by the manufactures.
1.6 MAXIMAL just offer guarantee for the product’s quality itself. Customers’ indirect losses, such as labor cost, stop-work loss, premium, loss of reputation, are excluded.
1.7 Starting time of guarantee: the day receipt of bill of lading.
1.8 Some agents have privilege on guarantee period. MAXIMAL exactly complies with the specific agreement signed with an agent.

2.1 MAXIMAL won’t be responsible for the upkeep if the replacement has been provided to customer for free.
2.2 MAXIMAL won’t be responsible for the electric parts or other parts which engine or controller manufacturers declare is out of guarantee range.
2.3 MAXIMAL won’t be responsible for the parts and components which customers purchase by themselves.
2.4 MAXIMAL will not provide replacements for the parts belong to item 1.1, 1.2 and 1.3, if customers open or take apart the assembly without receiving notify or permission from MAXIMAL.
2.5 In the following condition parts on one forklift will be out of guarantee:
2.6 This guarantee doesn’t take effect for special regulations beyond the manual and contract.

3.1 Information required for claim within guarantee period:
MAXIMAL necessarily need warranty claim file, photos and other clear information, which could prove that the part is faulty and the fault belongs to quality reason.
3.2 Requirements of warrant claim:
Please supply MAXIMAL with all the basic information including Country, forklift’s Model, Ser. No., C/No., Working hour, Damaged parts and Your analysis, which could help MAXIMAL do technical analysis efficiently and correctly. We can’t begin the technical analysis before receiving the complete information.
3.3 Requirement of photos:
3.4 If necessary, the fault parts shall be returned to MAXIMAL or part suppliers for checking.

4.1 This Guarantee, including the validity and interpretation of this Guarantee, and the legal relations of the Parties, shall be governed by the laws of China.
4.2 Any disputes or controversies or differences which may arise between the Parties out of, in relation to, or in connection with this Guarantee, which cannot be resolved by the Parties through discussions in good faith attempting to reach an amicable resolution, shall be finally settled by arbitration in Hangzhou, China, to be conducted in the English language, in accordance with the Rules of Conciliation and Arbitration of the International Chamber of Commerce, by one or more arbitrators appointed in accordance with the said Rules. Each Party is bound by an arbitration award rendered. Judgment upon an arbitration award rendered may be entered in any court having jurisdiction or application may be made to such court for judicial acceptance of the award or an order of enforcement, as the case may be.
4.3 If any term or policy of this Guarantee is invalid, illegal or incapable of being enforced due to any law or public policy, such term or policy shall be enforced to the fullest extent permitted by applicable law. All other terms and policies of this Guarantee nevertheless remain in full force and effect so long as the economic or legal substance of the transactions contemplated hereby is not affected in any manner materially adverse to any Party.
